Roundtable Discussion: The America Invents Act and Patents Strategy

The America Invents Act dramatically expanded the available options for resolving patent disputes outside of the courtroom. While the Act provides the broad contours for the new post-grant procedures, the rules which will govern these procedures are currently being drafted, debated, and decided upon. The new rules will shape how patent disputes are resolved.

Also discussed: the Mayo v. Prometheus case. Fish represented Mayo throughout its case, and several Fish attorneys attended oral arguments before the Supreme Court.
