A View From The Trenches Of The PTAB: Strategies For Patent Owners (& Patent Applicants)
Since 2012, about 10,000 Inter Partes Review (IPR) and Post-Grant Review (PGR) petitions have been filed to challenge the validity of patents. Gwilym Attwell will discuss high-level strategies critical for Petitioners and Patent Owners. He will detail strategies for success drafting petitions which are most likely to be instituted or for preparing Preliminary Patent Owner Responses most likely to lead to denial of institution. Throughout the presentation he will discuss practical lessons for drafting patent applications that maximize the Patent Owner’s chance of success if eventually challenged at the PTAB.
- For Petitioner: Petitions that maximize likelihood of success:
- What to do pre-filing; and
- How to deal with multiple petitions.
- For Patent Owner: Strategies to prevent institution:
- Points of attack in the Preliminary Patent Owner Response.
- Discuss factors considered by the PTAB when determining whether estoppel under 314 or 325 applies.
- How to design a patent portfolio unattractive for challenge and/or likely to survive attack.
