In this session, Conrad Gosen and Joseph Herriges will discuss the unique aspects of design patent litigation as compared to utility patent litigation. Their presentation will touch on strategies surrounding claim construction, expert discovery, and theme building, as well as on the Federal Circuit’s recent en banc hearing in the LKQ v. GM case, and how it could impact design patent litigation going forward.
