Patent Litigation in the United States: What Japanese Companies Need to Know to Protect their Most Important Assets

This intensive half-day program is designed to update Japanese practitioners on timely issues in US patent law and litigation. Fish Principals will lecture on patent litigation topics, including: recent developments at the ITC including a primer on what you need to know about discovery at the ITC; the special issues of discovery in pharmaceutical and biotech litigation; and, reliance on opinions of counsel in litigation and the practical implications of doing so. The lectures will be followed by a mock hearing on waiver of the attorney-client privilege when an accused infringer relies on an opinion of counsel to defend against charges of willful infringement. The session will be concluded by a panel discussion about practical litigation issues including e-discovery. The F&R team looks forward to continuing discussions informally after the seminar.
