Join Fish as we present two separate programs at the Patent Resources Group (PRG) Spring 2018 Advanced Courses Program, April 15-20, in New Orleans, LA.
Patent Infringement Litigation will be taught by Fish attorneys Betsy Flanagan, Ben Thompson, and Corrin Drakulich from April 15 to April 17. Betsy, Ben, and Corrin will discuss the practical and strategic keys to success when pursuing or defending against a patent infringement claim. The course will stress the early development of a cogent theme, and use of that theme to guide claim construction, fact and expert discovery, and trial presentation.
They will also lead attendees through all phases of a patent dispute, including pre-suit investigation and planning, the claim construction process, fact and expert discovery, the critical nature of trial preparation, the elements of an effective trial presentation, and post-trial activities. The course will provide updates on recent developments affecting patent trial practice, including venue, willful infringement and enhanced remedies, and motions for partial summary judgment.
Fish’s Janis Fraser, Terry Mahn, Dorothy Whelan, and Geoff Biegler, will teach Pharma and Biotech Patents: A Hatch-Waxman & BPCIA (Biosimilars) Immersion Course from April 18 to April 20. The course starts with a broad survey of the Hatch-Waxman and BPCIA legislation provisions that underpin the strategies to be discussed throughout the course.
The course then conveys both fundamentals and advanced legal strategies in three major areas: (1) pharmaceutical and biotech patent prosecution; (2) litigation and appeal; and (3) post-grant challenges such as inter partes review and post-grant review. This course provides valuable, practical information for the patent practitioner, whether in-house or in private practice, to use in maximizing protection of biotechnology and pharmaceutical inventions with an eye to possible future enforcement and post-grant validity challenges.
