Fish Secures IPR Win for Heil Environmental on Sanitation System Patent
Fish attorneys David Hoffman and Kenneth Darby recently secured a win for client The Heil Co. (d/b/a Heil Environmental) at the Patent Trial and Appeal Board (PTAB) when the Board found that a patent covering a system for tracking garbage cans that Heil challenged was invalid. The PTAB said in a final written decision that Heil had shown in IPR proceedings that each of the challenged claims in the patent were obvious based on earlier inventions and a magazine article. The patent at issue (U.S. Patent No. 8,146,798) is owned by Advanced Custom Engineered Systems & Equipment Co. and covers a system that allows municipalities to track garbage cans with radio frequency chips.
