Technical standards are industry norms that enable interoperability, promote safety, and create economies of scale. While technical standards are intended to be implemented on a wide scale, many standardized technologies are protected by patents (known as standard essential patents or SEPs), which raises inherent tensions between the inclusivity of standards and the exclusivity of patents. Once mostly limited to the telecommunications industry, SEPs and their attendant concerns are now poised to dramatically impact the electric vehicle (EV) charging and battery industries.
