Calculating damages and presenting or defending against various damages theories is a particularly complex and evolving aspect of patent law. Judges and juries alike often struggle to arrive at a reasonable royalty or lost profits award, with each party presenting its case using a wide variety of damages theories. While some damages theories and arguments come up with regularity, practitioners should know how to craft and respond to even the most niche theories and arguments, especially as damages awards in patent litigation grow ever larger.
