Developing Issues in Patent Damages

Hosts

Calculating damages and presenting or defending against various damages theories is a particularly complex and evolving aspect of patent law. Judges and juries alike often struggle to arrive at a reasonable royalty or lost profits award, with each party presenting its case using a wide variety of damages theories. While some damages theories and arguments come up with regularity, practitioners should know how to craft and respond to even the most niche theories and arguments, especially as damages awards in patent litigation grow ever larger.

On April 16, please join Principals Chris Marchese and Tim Rawson for a discussion of some less common and developing issues in patent damages. Our hosts will cover the following topics:

  • Apportionment, and whether it is required, in the lost profits context
  • Whether courts allow recovery of future royalties
  • Patent marking issues, including the impact of mixed periods of compliance and non-compliance

We hope you will join us!
