Law360 and Ahmed Davis discussed patent litigation trends from 2016. The high cost of patent litigation and the dramatic rise in patent rulings over recent years are two factors likely causing pause for patent plaintiffs.
Davis noted that "courts have recently been more vigorous in issuing rulings designed to stem the tide of non-practicing entity litigation, even at the trial court level."
“Patent holders really are thinking seriously about whether they want to bring those cases, and the firms that traditionally have brought them are taking a much harder look at those cases before they take them on,” Davis said.
